By accessing or using the TropsAI platform ("Service"), operated by TropsAI ("we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

TropsAI provides an AI-powered travel operations management platform for Travel Management Companies (TMCs) and travel agencies. The Service includes:

• Automated travel disruption detection and case management
• Email integration for processing travel-related communications
• Workflow automation for cancellations, modifications, and rebookings
• GDS integration for travel booking operations
• Client and traveler management tools

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable regulations
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service infrastructure
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to send spam or unsolicited communications
• Share your account credentials with unauthorized parties

5. Third-Party Integrations

The Service integrates with third-party services including Google (Gmail), Amadeus, and other providers. By connecting these integrations:

• You authorize TropsAI to access and process data from these services on your behalf
• You acknowledge that third-party services are governed by their own terms and policies
• You may revoke integration access at any time through the Service settings or the third-party provider's settings

Our use of Google API data complies with the Google API Services User Data Policy, including the Limited Use requirements.

6. Intellectual Property

The Service, including its design, features, code, and content, is owned by TropsAI and protected by intellectual property laws. You retain ownership of your data. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

9. Limitation of Liability

To the maximum extent permitted by law, TropsAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, losses resulting from:

• Travel booking errors or disruption management outcomes
• Third-party integration failures
• Data loss or unauthorized access
• Service interruptions

Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will meet your specific requirements or that AI-generated recommendations will be error-free. You are responsible for reviewing and approving automated actions before they are executed on behalf of travelers.

11. Termination

Either party may terminate these Terms at any time. You may stop using the Service and request account deletion. We may suspend or terminate your access if you violate these Terms or for any other reasonable cause with notice. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for a reasonable period following termination.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice within the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes shall be submitted to the courts of Barcelona, Spain.
